He is okay here per the beginning of the wording in rule #1
If you list an item for sale and the item in question has bids on it, you must let the auction run its course,
There were no bids yet on the item.

However, shakabomb: Please don't use the word "sale" and "bid" or "bidding" in the same thread. It is confusing.
